These Nods Terms ("Terms") represent a binding agreement between you, the user ("you," "your"), and NexasPulse LTD ("we," "us," "our"). They govern your purchase, receipt, and use of any credits provided by NexasPulse LTD for the purchase of digital games, downloadable content, or any associated services ("Nods"). By purchasing or using Nods, you expressly agree to comply with these Terms, which form part of our overall platform policies.
Nods
NexasPulse LTD offers the option to prepay for digital products and services available through our platform Overnod using a system of credits referred to as Prepaid Nods. These Prepaid Nods are a form of prepaid value that you can apply toward purchases on our platform, such as digital games, in-game content, and downloadable add-ons.
- Purpose: Prepaid Nods provide a flexible and convenient way for you to manage your purchases without the need to enter payment details for every transaction.
- Usage: Prepaid Nods may be used solely within the NexasPulse LTD platform for purchasing digital products offered for various platforms, including but not limited to PC, PlayStation, Xbox, and Nintendo. They are subject to availability and specific offerings at the time of your purchase.
- Additional Conditions: Certain promotional offers or deals may come with specific terms and conditions that apply solely to the use of Nods. These additional conditions will be clearly outlined at the point of purchase and must be adhered to in conjunction with these general Terms.
Example of Use
For instance, if you preload €100 worth of Prepaid Nods, these funds will be available for you to spend across any eligible games or content on the NexasPulse LTD platform, offering a seamless experience without needing to re-enter payment information.
Promotional Nods
NexasPulse LTD may occasionally offer Promotional Nods as part of various campaigns, promotions, or special events. These credits are granted free of charge and are intended to encourage engagement with our platform, such as participation in promotional offers, contests, or loyalty programs.
- Nature of Promo Nods: These credits cannot be purchased with money and are granted as a reward or incentive for specific actions. For instance, you may receive Promotional Nods for joining a promotion, referring a friend, or making specific purchases.
- Restrictions: Promotional Nods are not applicable to taxes, fees, or any costs not directly related to the purchase of digital goods or services. They can only be used for the designated products and services outlined during the promotion.
- Expiration: Promo Nods are typically time-sensitive and may expire after a specified period, which will be clearly indicated in the promotional terms. These credits are non-transferable and must be used before the expiration date.
Example of Use
As part of a holiday sale, NexasPulse LTD may offer 10 Promo Nods when you spend a minimum of €50 on the platform. These Promo Nods could be used toward a future game purchase, but they must be spent within 30 days of issuance or they will expire.
Nature of Nods
It is important to understand that Nods are a digital representation of prepaid value and are not a form of currency, legal tender, or a stored-value financial instrument. For pricing and internal accounting purposes only, one (1) Nod represents a prepaid value equivalent to one (1) euro (€1.00) at the time of purchase. This equivalence applies solely within the NexasPulse LTD platform. Nods have no intrinsic monetary value outside of the platform, are non-redeemable for cash, monetary compensation, or any fiat currency, and may only be used to purchase eligible products and services offered through the platform.
- Non-Monetary Value: Nods do not carry any legal status as a form of tender and are intended only for use within the NexasPulse LTD ecosystem. They have no cash equivalent and cannot be exchanged for any real-world currency.
- Non-Transferability: Nods are linked to your specific user account on the NexasPulse LTD platform and cannot be transferred to other accounts. Any attempt to sell, gift, or exchange Nods outside the platform will be considered a violation of these Terms.
- Exclusive Platform Use: Nods can only be used within the NexasPulse LTD platform to purchase products or services offered directly by NexasPulse LTD. They are not applicable for use in any external platforms or third-party services.
Refund Policy for Nods
The NexasPulse LTD platform supports two distinct types of Nod-related transactions:
(a) the purchase of Nods (account balance top-ups), and
(b) the purchase of digital items using Nods.
As a general rule, both types of transactions are considered final and non-refundable. However, NexasPulse LTD reviews all refund requests on a case-by-case basis, and, at its sole discretion, may grant a refund in exceptional circumstances.
Purchases of Items Using Nods
Items purchased using Nods are generally non-refundable once the transaction has been completed.
If, following an internal review, NexasPulse LTD approves a refund for an item purchased with Nods, the refunded amount will be credited back to the customer’s Nods balance. No cash, fiat, or alternative refund method will be provided for such transactions.
Purchase of Nods (Balance Top-Ups)
The purchase of Nods constitutes a balance top-up and is generally non-refundable.
If, following an internal review, NexasPulse LTD approves a refund for a Nods purchase, the refunded amount will be returned to the original payment method used for the transaction and in the same fiat currency in which the purchase was made. No refunds will be issued to alternative payment methods or in different currencies.
Discretion and No Precedent
Any refund granted by NexasPulse LTD is exceptional, discretionary, and non-precedential. Approval of a refund in one instance does not create an obligation to issue refunds in future cases.
Nods Expiration
Nods, including both Prepaid Nods and Promotional Nods, do not have an expiration date and remain valid indefinitely once credited to a user’s account. Nods will remain available for use on the NexasPulse LTD platform unless otherwise restricted by applicable law or in cases of account suspension, termination, or other actions taken in accordance with these Terms.
Managing Your Nods Balance
To help you keep track of your credit usage, NexasPulse LTD provides a convenient system for monitoring your available Nods balance. You can access your current balance by logging into your account and reviewing your transaction history.
- Responsibility: It is your responsibility to ensure that the correct number of credits is added to or deducted from your balance during transactions. If any discrepancies arise, you should contact customer support immediately.
- Balance Transparency: Your Nods balance does not function as a traditional bank account, digital wallet, or stored-value account. It is a prepaid value system strictly for use on NexasPulse LTD’s platform and is not FDIC insured or subject to financial regulations applicable to payment accounts.
Prohibited Transfers and Activity
NexasPulse LTD prohibits the transfer, sale, or gifting of Nods. Engaging in any such unauthorized transactions will be considered a violation of these Terms and could result in severe consequences.
- Unauthorized Transfers: Any attempt to transfer or trade Nods outside of your NexasPulse LTD account is strictly forbidden and may result in the forfeiture of your credits.
- Consequences: If NexasPulse LTD identifies an attempt to sell, transfer, or otherwise exploit the Nods system, we reserve the right to:
- Revoke the affected Nods without compensation;
- Suspend or terminate your NexasPulse LTD account;
- Take legal action where necessary to enforce these Terms.
Termination and Account Suspension
NexasPulse LTD reserves the right to suspend or terminate your account or access to Nods under certain conditions, such as violation of these Terms, fraudulent activity, or misuse of the platform.
- Violation of Terms: If you violate any provision of these Terms, NexasPulse LTD may immediately revoke your access to Nods and terminate your account. This may also result in the forfeiture of any unused credits.
- Inactive Accounts: If your account remains inactive for a prolonged period (as defined by our Expiration Policy), your remaining Nods may be forfeited.
Modifications to the Nods Terms
NexasPulse LTD reserves the right to modify these Nods Terms at any time. Any updates or changes to the Terms will be clearly communicated on our platform, and in cases of significant changes, you may also receive a direct notification.
- Effective Date: Changes will take effect immediately upon posting on our website, unless otherwise stated. If you continue using Nods after the changes have been implemented, you are considered to have accepted the new Terms.
- Ongoing Use: By continuing to engage with the platform after modifications are made, you agree to adhere to any revised conditions outlined in these Terms.
